These Website Terms govern browsing and use of The Community Schools CIC’s public website. They do not replace the separate Parent/Client Terms and Conditions that apply to tutoring bookings or purchases, nor the separate rules, contracts and policies governing authorised access to our online administration system.

1. About us

The Community Schools CIC is a Community Interest Company registered in England and Wales under company number 14658587. We are a not-for-profit cooperative of qualified teachers providing tutoring and related educational services. In these Terms, ‘we’, ‘us’ and ‘our’ mean The Community Schools CIC and ‘you’ means a person using the public website.

2. Using the website and acceptance

By using the public website you agree to comply with these Website Terms as rules governing website use. They are not intended to create or replace the contractual terms governing tutoring services, administration-system accounts or other material transactions. Where a booking, registration or other service requires contractual acceptance, the applicable terms will be presented separately as part of that process.

3. Website information

We take reasonable care to keep website information accurate and current, but content is general information and may change. It is not legal, medical or other professional advice. Course, tutor, availability, location, timetable, fee and service information may change; a booking is confirmed only through the applicable booking process and service terms.

4. Website availability

We aim to keep the website available and functioning but do not guarantee uninterrupted or error-free access. We may suspend, restrict, withdraw or change all or part of it where reasonably necessary for maintenance, security, legal, technical or operational reasons.

5. Online administration system

Our online administration system is not governed solely by these browse-use Website Terms. Access is restricted to authorised users and is governed by the applicable Parent/Client Terms, tutor employment or subcontractor terms, Privacy Policy, safeguarding requirements and a separate administration-system acceptable-use standard.
  • Users must use only the account issued or authorised for them and must keep credentials confidential.
  • Accounts and login details must not be shared between family members, students, tutors or other people unless The Community Schools has expressly provided or authorised that access arrangement.
  • Users must promptly report suspected compromise or unauthorised access.
  • Access may be restricted, suspended or removed where necessary for security, safeguarding, contractual or operational reasons.
  • Tutor access will be removed promptly when employment or engagement ends or when access is no longer required. Student/parent/client access will be removed or restricted when the service relationship ends or access is no longer appropriate, subject to any continuing lawful access rights.
  • Users must not gain unauthorised access, interfere with security controls, introduce malicious software, unlawfully scrape or extract data, access another user’s account or use the system for an unlawful, abusive or unauthorised purpose.
Any student account arrangements, including whether students receive individual logins and any age or parental- authorisation requirements, will be specified in the administration-system acceptable-use arrangements rather than inferred from these Website Terms.

6. Privacy, children and personal information

Our Privacy Policy explains what personal information we collect, our purposes and lawful bases, recipients, retention arrangements and data-protection rights. Children and young people may access parts of our website and online services. We design and operate child-accessible services with their privacy, safety and age-appropriate understanding in mind and keep relevant children’s privacy requirements under review.

Where an online feature is directed at, or likely to be accessed by, children, its privacy information and settings will be considered separately from these general Website Terms.

7. Cookies and similar technologies

We use cookies and similar technologies only in accordance with applicable UK privacy and electronic- communications law. Strictly necessary technologies may operate without consent where the law permits. Non- essential technologies, including analytics, advertising or similar technologies where consent is required, will not be activated until the required consent has been obtained.

A separate Cookie Notice should identify the cookies and similar technologies actually in use, their provider, purpose, duration and whether they are first- or third-party. Where consent is required, the website should provide a genuine choice, with rejecting non-essential cookies as straightforward as accepting them and a way to change preferences later.

8. Intellectual property

Unless otherwise stated, the website and its original content, branding, text, graphics, teaching materials and other materials are owned by or licensed to The Community Schools CIC and are protected by intellectual-property law. References to ‘our content’ include material owned by us and material which we are authorised to use under licence.

You may view and print reasonable extracts for personal, non-commercial use. You must not reproduce, republish, sell, commercially exploit, systematically copy or modify protected content without permission, except where law or the relevant licence permits.

9. Accessibility

We aim to make our website and online information accessible and to anticipate barriers for disabled users. We keep accessibility under review, including navigation, readable presentation, keyboard use, alternative text and compatibility with commonly used assistive technologies where appropriate.

If you cannot access information or complete a website process because of a disability or accessibility barrier, contact admin@thecommunityschools.co.uk . We will consider an accessible alternative or reasonable adjustment and will not require a disabled user to rely on the website where another reasonable means of access can be provided.

10. Links to and from other websites

Third-party links are provided for convenience or information. We do not control third-party sites and are not responsible for their content, availability, security or privacy practices. You may link to our public website fairly and lawfully without implying an endorsement or association that does not exist.

11. Prohibited use

  • Using the website for an unlawful, fraudulent, abusive or harmful purpose;
  • Bullying, harassing, threatening, discriminating against or exploiting another person;
  • Uploading or transmitting malicious code or unlawful/harmful material;
  • Impersonating another person or misrepresenting your identity or relationship with us;
  • Interfering with the website, online systems, security controls or another user’s access;
  • Collecting, scraping or using personal information unlawfully.

12. Safeguarding and online safety

Where our website or online services are used in connection with tutoring, applicable safeguarding, Online Safety, Student Behaviour and Tutor Code requirements also apply. A safeguarding concern must be reported under our current safeguarding procedures. Nothing in these Website Terms prevents or delays a safeguarding referral, protected disclosure, police report or report to another appropriate authority.

13. AI-enabled features

If we introduce an AI-enabled feature on the public website or administration system, we will provide appropriate information before or when it is used about the feature’s purpose, the personal data it processes where applicable, relevant providers or recipients, important limitations and whether automated decision-making or profiling is involved. AI features remain subject to our Privacy Policy, safeguarding, accessibility and applicable service terms. Users must not assume that an AI-generated output is professional, safeguarding, medical or legal advice.

14. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or other liability that cannot lawfully be excluded. Consumers’ statutory rights are unaffected.

We are responsible to consumers for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill, subject to lawful limits. We are not responsible for unforeseeable losses or business losses suffered by a consumer. Separate tutoring contracts govern liability relating to tutoring services.

15. Security and devices

We take reasonable measures to maintain website security but cannot guarantee that the website will always be free from bugs, viruses or harmful material. Users are responsible for appropriate security protection on their own devices and networks.

16. Alternative dispute resolution and complaints

Complaints about tutoring or our services should be made under our published Complaints Procedure. Where consumer law requires us to provide information about an alternative dispute-resolution entity, or where a professional or membership obligation requires use of a particular ADR provider, we will publish the required provider name and website details in our website information and applicable general service terms. This clause does not state that a particular ADR provider applies unless that has been verified.

17. Changes

We may update the website and these Terms to reflect changes in law, regulation, technology, security or services. The current version will show its effective or review date. A change to these Website Terms will not retrospectively alter a separate tutoring contract unless that contract and the law permit it.

18. Governing law

These Website Terms are governed by the law of England and Wales. Consumers retain any rights under applicable law to bring proceedings in courts available to them. Business users agree to the jurisdiction of the courts of England and Wales, subject to any separate written agreement.

19. Severance and third-party rights

If any provision of these Website Terms is found unlawful, invalid or unenforceable, the remaining provisions will continue in effect so far as legally possible. Unless expressly stated otherwise, a person who is not a party to these Website Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce them.
